Right to remain in employment for up to 68 years

Published Jan 07, 2020

According to the Employment Protection Act (Lagen om Anställningsskydd), employees' right to remain in employment after the age of 67 will be increased in two steps: On January 1, 2020, the age limit will be increased from 67 to 68 years, and in 2023 from 68 to 69 years (hereinafter referred to as “LAS-age”).

The regulations that have applied to terminate an employment by written notice at the age of 67, are replaced by a simplified dismissal procedure. In this type of dismissal, the employer will not apply the rules on a factual basis. The employee does not have a pre-employment right to re-employment, nor can he or she have the termination annulled. The notice period is limited to one month. The regulations apply from the time the employee reaches the LAS age and at any time thereafter.
